General terms and conditions
PREAMBULE
Les conditions générales de vente décrites ci-après détaillent les droits et obligations de l’entreprise individuelle Clémence Coutelle-Rebut et de son client dans le cadre de la vente des prestations de services et marchandises suivantes : service d’illustration en freelance – achat de prints et produits dérivés – achat d’illustrations personnalisées.
The Parties are referred as follows :
On the one hand,
The term «Clients» refers to any natural or legal person having requested Another Pleas’s professional services as part of a contract or purchase of the following items : freelance illustration service, art prints or other by-products, personalised illustrations.
On the other hand,
The term « Another Please » refers to the sole proprietorship Another Please, represented by its owner Clémence Coutelle-Rebut whose the registered office are located at 3 rue Henri Montaut, 31400, TOULOUSE, whose contact information is : contact@anotherplease.fr.
ARTICLE 1 – The company
The sole proprietorship Another Please, represented by its owner Clémence Coutelle-Rebut, has its registered office at 3 rue Henri Montaut, 31400, TOULOUSE. Its contact information is : contact@anotherplease.fr.
Another Please’ portfolio and commercial offers are available on the website www.anotherplease.fr.

ARTICLE 2 – Object
By signing the quote or placing an order online, Clients acknowledge and agree to abide the present terms and conditions. Any delivery by Another Please (products and services) par Another Please this indicates the full and unreserved acceptance of the present terms by Clients.
Parties agree that their relations will be exclusively governed by signed quotes or online orders, and by the present terms and conditions, to the exclusion of all other conditions including those of Clients.
Another Please reserves the right to modify its general conditions of use and prices at any time, by simply updating the relevant webpage.
These new conditions will not apply to contracts signed or orders placed before the update.
ARTICLE 3 – Offers
Another Please offers freelance illustration services, as well as personalised illustrated portraits, art prints and by-products.
ARTICLE 4 – Legal capacity
Clients declare that they are of legal age and have legal capacity to contract the services supplied by Another Please.
ARTICLE 5 – Freelance illustrations
5.1. Prices
Prices for merchandise and services are those which are in effect on the day the order is accepted or the quote is signed. They are given in euros all taxes included, except shipping and processing charges. Another Please commits to bill services at the price given at the time the order was validated.
Une majoration de 15% du tarif TTC sera appliquée à toute demande de réalisation dans un court de délai (inférieur à 10 jours ouvrés).
5.1. Quote acceptance
Another Please provides personalised quotes to Clients upon request. Quotes describe the type of service provided, the global price offer and the payment conditions.
Quotes are valid for a fixed duration of one month. Prices are not guaranteed past this period.
Any freelance service requires the acceptance and signature of the quote by the Client prior to the service delivery. Freelance orders are considered definitive upon the reception by Another Pleaseof the signed quote and a deposit of 30% of the total offer price.
5.3. Modifications
Any modification of service requested after the acceptance of the quote may entail price adjustments.
Another Please reserves the right to refuse these modifications without damage to any other course of action.
5.4. Payment
Freelance illustration services are to be paid by wire transfer (the bank information will be handed over to Clients upon acceptance of the quote) or cheque.
Lors de l’enregistrement de la commande, le Client devra verser un acompte de 30% du montant global de la facture. Le solde devra être payé sous 15 jours à réception de la facture, envoyée par Another Please par mail après la prestation.
Any amounts not paid by the due date stated on the invoice happen automatically and without prior notice, annual penalties for 15% with an additional fixed fee of 40€ (French décret n°2012-1115, October 2nd 2012). In case of late payment, we may suspend all pending orders, without damage to any other course of action.
ARTICLE 6 – Portraits personnalisés (et autres illustrations personnalisées)
6.1. Prices
Prices for merchandise and services are those which are in effect on the day the order is accepted. They are given in euros all taxes included, except shipping and processing charges. Another Please commits to bill merchandise at the price given at the time the order was validated.
Le tarif des portraits personnalisés varie en fonction du nombre de personnes représentées. Les animaux sont facturés au même tarif qu’une personne. Ces tarifs et les modalités de livraison sont précisés sur la fiche produit.
By validating the order on the website www.anotherplease.fr, the Client accepts the present terms and conditions, the illustration process, the cost of preparation and the cost of delivery of the order. We reserve the right to decline or modify any order that does not comply with its prices policy (i.e. an order and payment for 2 people when the actual service requested is for a family of three).
Prices indicated on the product page include:
- the illustration service for the number of people chosen by the Client - medium close shot
- an illustrated frame chosen by the Client out of Another Please’ library
- the choosing of a global colour palette
- one (1) revision of the sketch and three (3) colour modifications of the final illustration colour modifications of the final illustration.
- La livraison de l’illustration au format numérique ou imprimée sur du papier mat de qualité.
- Le fichier pourra être fourni sur demande du client en cas de livraison au format papier.
Another Please is happy to work with Clients on specific ideas. For any particular request, please contact us at contact@anotherplease.fr to request a quote. The general terms and conditions for freelance illustration services described here above will apply to this service.
6.2. Modifications
A modification is defined as one change and not one request for many changes. For example, asking to modify the hair length and the color of the dress corresponds to two changes.
Any extra modification of the final illustration will be charged a fixed fee of three (3) euros per modification. Any significant modification of the portrait will, by right, lead to a reassessment of the service price.
6.3. Payment
Personalised illustrations offered by Another Please are to be paid online upon order or by wire transfer. Particular requests entailing the signature of a quote are to be paid exclusively by wire transfer or cheque.
Orders of personalised portraits will be processed upon receipt of the full payment. Any amounts not paid by the due date stated on the invoice happen automatically and without prior notice, annual penalties for 15% with an additional fixed fee of 40€ (French décret n°2012-1115, October 2nd 2012). In case of late payment, we may suspend all pending orders, without damage to any other course of action.
6.4. Delivery and return policy
Personalised portraits can be delivered either as a high-quality digital file or as a print (A4 to A3). Printing and shipping costs for the print option will be borne by the Client.
Given the custom nature of this work, personalised illustrations can not be returned, refunded or exchanged (cf. Article 9 of the present terms and conditions).
ARTICLE 7 – Purchase of by-products
7.1. Prices
Les prix des produits vendus sont ceux en vigueur au jour de la prise de commande. Ils sont libellés en Euros, Toutes Taxes Comprises (au taux de TVA applicable au jour du paiement)except shipping and processing charges.. Les frais de livraisons dépendent du montant de la commande, du poids, ainsi que du pays de destination de la livraison. Another Please se réserve le droit de modifier ses prix à tout moment mais s’engage à appliquer les tarifs en vigueur qui vous auront été indiqués au moment de votre commande.
By validating the order on the website www.anotherplease.fr vaut acceptation du devis par le Client. Les commandes ne seront traitées qu’à réception effective du paiement. Toute somme non payée à sa date d’exigibilité mentionnée sur la facture produira, de plein droit et sans mise en demeure préalable, des pénalités de retard annuelles de 21%, auxquelles s’ajoutera l’indemnité forfaitaire de 40 € prévue par le décret n°2012-1115 du 2 octobre 2012. En cas de retard de paiement, nous suspendrons l’intégralité de la commande du client en cours sans préjudice de toute autre voie d’action.
7.2. Payment
Orders of by-products are to be paid online or by wire transfer.
ARTICLE 8 – LIVRAISON
Modalités de livraison
Another Please livre en France métropolitaine (Corse et Monaco inclus), Allemagne, Danemark, Autriche, Belgique, Croatie, Espagne, Estonie, Finlande, Hongrie, Irlande, Lettonie, Lituanie, Luxembourg, Pays-Bas, Pologne, Portugal, République Tchèque, Roumanie, Royaume-Uni, Serbie, Slovaquie, Slovénie, Suisse, Suède, selon des modalités, délais et frais de port décrits ci-après et variant selon le prestataire choisi par le client lors de sa commande. Un email de confirmation est envoyé au client au moment de l’expédition de sa commande. Il peut accéder au suivi de sa commande et des différentes étapes de livraison en se référant sur le site de La Poste grâce à son numéro de suivi.
Délais de livraison
Les commandes sont traitées sous 10 à 15 jours après passage de la commande.
Another Please met en œuvre ses meilleurs efforts afin de respecter les délais de livraison des produits commandés. Cependant, le dépassement des délais de livraison ne peut donner lieu à dommages-intérêts, retenues ou annulation de commande.
Toutefois, en cas de livraison non effectuée, pour cause de force majeure, dans un délai de 30 jours à compter de son enregistrement, le client pourra résilier sa commande.
Dans ce cas, Another Please reversera le paiement éventuellement perçu, à l’exclusion de toute indemnité ou dommage-intérêts réclamés par le client.
Seront notamment considérés comme cas de force majeure les faits d’incendie, de grève totale ou partielle, d’accident ou défaillance du prestataire de transport ou d’un fournisseur de Another Please.
En toute hypothèse, la livraison dans les délais suppose que le client soit à jour de ses obligations à l’égard de Another Please. Another Please ne saura en aucun cas être tenue responsable des conséquences d’un retard d’acheminement.
Le risque du transport n’est pas supporté par le vendeur. En cas de produits endommagés, merci de contacter La Poste puis Another Please.
L’acheteur est responsable des frais de port choisis et donc appliqués à sa commande.
A réception de la commande
Le client doit vérifier la conformité de la marchandise livrée au moment de la livraison. Le risque du transport n’est pas supporté par le vendeur. En cas de produits endommagés, merci de contacter La Poste puis Another Please.
ARTICLE 9 – Droits d’auteur et de publication
Unless expressly stated otherwise, Another Please retains all copyright over commissioned artwork, including personalised family portraits.
Unless otherwise specified in the project agreement with the client, Another Please reserves the right to publish commissioned artwork, as well as its work-in-progress versions both online and in the illustrator’s portfolio.
Commissioned artwork is for personal use only. Please contact Another Please for any commercial or press use of the illustrations.
Clients can share personalised illustrations on their websites or social media provided that Another Please is duly mentioned.
ARTICLE 10 – Délai de rétractation & annulation de commande
10.1. Conformément au Code de la Consommation, le délai de rétractation est de 14 jours après acceptation et signature du devis pour les prestations freelance. Passé ce délai, aucun remboursement d’acompte ne pourra être envisagé.
Conformément au Code de la Consommation, le client dispose d’un délai de rétractation de 14 jours francs à compter de la réception de ses produits pour retourner tout article ne lui convenant pas, dans son emballage d’origine et en bon état, pour échange ou remboursement. En cas d’exercice du délai de rétractation, Another Please est tenu au remboursement au profit du client des sommes qu’il a versées, sans pénalités, dans un délai de 14 jours à l’exception des frais de retour (Article L121-20 du code de la consommation).
ATTENTION : aucune rétractation ne sera acceptée si le produit retourné est impropre à sa re-commercialisation. A défaut, le produit sera retourné au client, à ses frais. Au-delà du délai de rétractation, tout retour de produit, qu’il intervienne au titre du règlement amiable d’une réclamation ou de tout autre motif devra faire l’objet d’un accord formel entre le client et Another Please.
10.2. Pour garantir des délais de livraison raisonnables, le droit de rétractation ne pourra pas être exercé dans les situations suivantes :
- for services that have been fully executed and delivered to the Client prior to the end of the withdrawal period, and for which the Client expressly renounced their right of withdrawal ;
- for services delivered only as digital files ;
- for personalised services and products custom-made for the Client ;
- when the Client is a professional.
10.3. En cas d’annulation d’une prestation freelance par le client, aucun acompte ne pourra être remboursé.
10.4. Afin d’exercer son droit de rétractation, le Client doit informer Another Please par e-mail à l’adresse contact@anotherplease.fr dans le délai prévu par les présentes conditions.
ARTICLE 11 – Force majeure
Another Please shall not be held responsible for delays in the execution or the non-execution of its commitments arising as a result of events outside its normal control, including production interruptions, difficulties in acquiring or shortages of materials, delays in transport, strikes, lock outs, work interruptions or other collective labour disputes, whether or not they are directly related to the company or its suppliers and this even in the event these events are foreseeable.
ARTICLE 12 – Renseignements & réclamations
12.1 Toute précision relative aux présentes conditions générales de vente, demande d’information et/ou réclamation doit être faite par courrier à Another Please, 3 rue Henri Montaut, 31400, Toulouse, qui s’efforcera de répondre à toute question dans les meilleurs délais.
12.2 Les conditions générales de vente sont soumises au droit Français. À défaut d’un accord amiable entre les parties, tout litige se rapportant à leurs exécutions ou à leurs interprétations seront de la compétence exclusive du Tribunal de Commerce de Toulouse, même en cas de référé, d’appel en garantie ou de pluralité de défendeurs.
ARTICLE 13 – Dispositions générales
13.1 Les CGV sont consultables en ligne et peuvent être modifiées à tout moment à la discrétion d’Another Please sans autre formalité que leur mise en ligne. Seule la dernière version sera applicable.
13.2 Si une quelconque clause des présentes CGV était déclarée nulle, elle serait réputée non écrite mais n’entraînerait pas la nullité des présentes CGV.
13.3 Les présentes conditions générales de vente ont été rédigées le 20 octobre 2022 et sont entrées en vigueur le 20 octobre 2022.
